Welcome to BARAKAH ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of our website at brkh.shop (the "Site") and any purchases you make through the Site. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

By using the Site, you represent that you are at least the age of majority in your province, state, or country of residence, or that you have the consent of a parent or guardian. You may not use the Site for any illegal or unauthorized purpose.

2. Products & Pricing

All product descriptions, images, and pricing on the Site are subject to change without notice. We make every effort to display product colours and details accurately; however, we cannot guarantee that your device's display will reflect the exact appearance of the product. Prices are listed in USD and are subject to applicable taxes calculated at checkout.

We reserve the right to limit quantities, refuse orders, or cancel orders at our sole discretion, including orders that appear to be placed by resellers, bots, or fraudulent accounts.

3. Orders & Payment

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order. Your order is confirmed only when we send you an order confirmation email.

Payment must be made in full at the time of purchase. We accept the payment methods displayed at checkout. You agree that all payment information you provide is accurate and that you are authorized to use the payment method.

4. Shipping

We aim to ship all orders promptly. Estimated delivery timelines are provided on our Shipping Policy page and are not guaranteed. BARAKAH is not responsible for delays caused by carriers, customs, weather, or other circumstances outside our control.

Risk of loss and title for items purchased pass to you upon delivery to the carrier. For full shipping details, please refer to our Shipping Policy.

5. Returns & Refunds

If the fit isn't right, you have 14 days from the date of delivery to initiate a return for a full refund. Items must be returned unworn, unaltered, and in their original packaging with all tags attached.

Items that are worn, washed, altered, or returned without original packaging and tags will not be accepted for a refund.

To initiate a return, please contact us at brkh.inquiries@gmail.com with your order number and reason for return. Once we receive and inspect your return, we will notify you of the approval or rejection of your refund. Approved refunds will be processed to your original payment method within 10 business days.

For items received damaged, defective, or incorrect, please contact us immediately and we will resolve the issue at no cost to you.

6. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, images, designs, and software — is the property of BARAKAH or its licensors and is protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

7. User Conduct

You agree not to:

• Use the Site in any way that violates any applicable law or regulation
• Attempt to interfere with the proper functioning of the Site
• Use automated systems (bots, scrapers, etc.) to access the Site
• Impersonate any person or entity
• Submit false or misleading information

8. Limitation of Liability

To the fullest extent permitted by applicable law, BARAKAH and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any products purchased through it.

Our total liability for any claim arising from your use of the Site or our products shall not exceed the amount you paid for the specific product giving rise to the claim.

You agree to indemnify and hold harmless BARAKAH, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

The Site may contain links to third-party websites or services that are not owned or controlled by BARAKAH. We are not responsible for the content, privacy policies, or practices of any third-party sites.

12. Modifications to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
